A letter from the U.S. Customs and Border Protection's acting commissioner concedes the agency does not have the legal authority to search cloud data on phones at the U.S. border, NBC News reports. The letter was sent in response to inquiries from Sens. Ron Wyden, D-Ore., and Rand Paul, R-Ky., both of whom introduced legislation in April that would make searches and seizures of phones at the border illegal without probable cause. CBP Acting Commissioner Kevin McAleenan said his agency does not need probable cause to search travelers' phones at the border but that only applies to data stored directly on devices, such as call histories, text messages, contacts, photos and videos.
