POLITICO conducted a series of interviews with a host of different companies regarding the EU & U.S. Privacy Shield, finding that many organizations are concerned the agreement isn’t secure enough to garner their support. “People will be reluctant to give this a try,” said Factory’s Simon Schaefer. “The goal is to have an agreement that makes it through court, and I’m not sure we have that.” Organizations cite the lack of support from European regulators and privacy advocates as a reason for their hesitance. “You’re still in the same spot as a business: You still don’t have the certainty you need to move forward,” said Barnes & Thornburg’s Brian McGinnis, CIPP/US. Some lawyers, like Fieldfisher’s Olivier Proust, CIPP/E, suggest holding off on supporting the agreement in its current state.
