The "Schrems II" decision is part of a long-running series of issues regarding the appropriate role of surveillance in our society and its inevitable collision with privacy. Ultimately, the decision examined two issues in U.S. law: the remedies available to Europeans for surveillance in the U.S. and the scope of surveillance authority in the U.S. To understand the decision, as well as chart a path forward, it is critical to understand both issues. To help, DLA Piper Partner Andrew Serwin, CIPP/A, CIPP/C, CIPP/E, CIPP/G, CIPP/US, CIPM, CIPT, who also provided an Expert Report in the Irish High Court case that led to "Schrems II," wrote a white paper on the history and intricacies of U.S. surveillance law and what it means for the future of trans-Atlantic data flows.
