Following the decision to have the Court of Justice of the European Union determine the validity of standard contractual clauses, lawyers for the U.S. government said it is important their views are taken into account when the High Court finalizes its questions, RTÉ reports. As the questions to the CJEU are prepared, Senior Counsel Eileen Barrington said the U.S. government wants to have its views on the questions considered to ensure the description of U.S. law in the High Court’s final referral order is accurate. The High Court heard Facebook is considering appealing against the decision to have the CJEU review the clauses.
