In an Op-Ed for The Hill, Software & Information Industry Association President and CEO Ken Wasch writes that the Federal Trade Commission, as the de facto privacy and security regulator for U.S. companies, will have a difficult task ahead in “an age of rapid technological evolution.” Wasch writes that, moving forward, the FTC should adopt a case-by-case, tailored approach to regulation and enforcement to “avoid adopting an overly broad definition of informational injuries that threatens the data-driven innovation that powers the 21st-century economy.” Wasch adds that the FTC's approach to regulation should be balanced to provide both consumer protection and technological opportunities.
