Reuters reports New York’s Court of Appeals voted 7–0 that a user’s Facebook photos or other relevant information could be included in a court’s discovery, even if they are restricted from public view by a user’s particular privacy settings. Despite noting the “significant controversy” over what constitutes private information on Facebook, Chief Judge Janet DiFiore wrote, “Some materials on a Facebook account may fairly be characterized as private,” adding, “but even private materials may be subject to discovery if they are relevant.” The decision reinstates a trial judge’s ruling involving the discovery of a user’s Facebook photos as evidence in a case.
