Documents filed in federal court show that victims of the Marriott data breach are arguing against an arbitration clause that would prevent them from joining class-action lawsuits or other court actions in return for prepaid fraud-monitoring services through WebWatcher, BankInfoSecurity reports. The complaint states, "Marriott engaged in an underhanded attempt to induce putative class members to waive and limit their legal rights, creating both uncertainty about whether to accept the WebWatcher product and whether they were still permitted to pursue legal claims in court through a class action vehicle." However, a declaration from Marriott has since shown that it does not intend to enforce those terms.
