The Internet Corporation for Assigned Names and Numbers has filed an appeal with the Higher Regional Court in Cologne, Germany, over a decision made by the Regional Court in Bonn. ICANN wants the court to issue an injunction forcing domain registrar EPAG to continue sharing WHOIS data under its Registrar Accreditation Agreement. If the regional court does not issue the injunction, ICANN wants the case referred to the Court of Justice of the European Union. “We are continuing to seek clarity of how to maintain a global WHOIS system and still remain consistent with legal requirements under the GDPR,” ICANN General Counsel and Secretary John Jeffrey said. “We hope that the Court will issue the injunction or the matter will be considered by the [CJEU].” Editor's Note: IAPP Staff Writer Molly Hulefeld wrote about the overhauling of WHOIS ahead of the GDPR in this piece for The Privacy Advisor.
