Illinois Policy reports that the state has undergone a proliferation of class-action lawsuits from employees alleging that their employer violated the state’s Biometric Information Privacy Act, most often involving the use of fingerprint machines as time clocks. BIPA, enacted in 2008, requires the specific purpose and length of time for which a person’s biometric information is collected, stored or used to be provided in writing and also requires their written consent from a person for providing such data. Since July, employees have filed at least 26 class-action lawsuits against Illinois employers under the law. While the outcome of the litigation is unclear, the article explains that the spike of lawsuits should be of great concern for job growth in the state.
