Future of Privacy Forum Senior Counsel Gabriela Zanfir-Fortuna and Managing Director, Europe Rob van Eijk look back at comments made by Thomas von Danwitz, who served as judge-rapporteur in the first two "Schrems" cases. During a conference on Data Privacy Day, von Danwitz said data transfers to third countries without adequacy standing could be done via Article 49 derogations in the EU General Data Protection Regulation. He added Article 49 derogations should be explored more thoroughly and that they "are not so narrow that they restrict any kind of transfer, especially when we’re talking about transfers within one corporation or group of companies."
