In an op-ed for The Globe and Mail, David Fraser writes that Canada should forgo a “right to be forgotten law as the Office of the Privacy Commissioner of Canada considers how to handle the topic of online reputation. “While it is an important discussion to have, the answer is very likely no: We cannot shoehorn such a right into our current privacy laws and any new laws would not withstand a Charter challenge,” Fraser argues. He adds that the law would undermine the “free expression” capabilities of Canadian citizens, search engines, and the press. “We need to tread very carefully. The debate we are about to have will certainly be interesting and, hopefully, unforgettable.”
