Irish High Court Decision in DPC v. Facebook Ireland Limited and Max Schrems

On October 3, 2017, the Irish High Court handed down this 129 page judgement agreeing with Schrems' view that the Irish Data Protection Commission has "well founded concerns" over U.S. surveillance of Facebook. The court will, on Oct. 11, determine questions that will be referred to the Court of Justice of the European Union. The CJEU ruling may have a significant effect on U.S. electronic communications service providers and their use of standard contractual clauses to transfer data from the EU.
