This toolkit from the European Data Protection Supervisor responds to requests from EU institutions for guidance on the particular requirements stemming from Article 52(1) of the Charter of Fundamental Rights of the European Union, which states that any limitation on the exercise of the right to personal data protection (Article 8 of the Charter) must be "necessary" for an objective of general interest or to protect the rights and freedoms of others. It is intended to help assess the compliance of proposed measures with EU law on data protection and aims to better equip EU policymakers and legislators responsible for preparing or scrutinizing measures that involve processing of personal data and limit the right to the protection of personal data and other rights and freedoms laid down in the charter.
