In his IAPP Global Privacy Summit 2025 keynote speech, Orin Kerr advocated for a "digital Fourth Amendment" to govern search and seizure of digital assets. Existing laws, he maintains, are too oriented toward the physical world to protect our freedoms in a world where we constantly create potentially incriminating evidence on personal devices and in cloud databases.
