Mark H. Francis is a New York-based attorney working on all things tech and data, including privacy, cybersecurity, data eco-systems, artificial intelligence and intellectual property matters.



In January 2021, Mark was appointed to the U.S. Department of Homeland Security (DHS) Data Privacy and Integrity Advisory Committee (DPIAC), which provides advice at the request of the Secretary of Homeland Security and DHS Chief Privacy Officer on issues within DHS that relate to personally identifiable information, as well as data integrity and other privacy-related matters.



Mark’s day-to-day legal practice spans counseling, compliance, tech transactions and litigation, serving as an experienced and pragmatic data risk manager. On the counseling front, Mark provides guidance on cybersecurity and data privacy policies and programs, AdTech, data strategy and information governance, AI/ML, technical controls, cross-border data transfers, and data privacy laws across a number of industries. Mark also assists clients in preparing and negotiating data and technology agreements, including cloud/SaaS services agreements and data/technology licenses.



Mark regularly counsels clients on data breaches and other incidents across a number of industries, including healthcare, financial services, retail, technology, consulting, industrial and telecommunications. He advises clients on internal investigations, notifications and interactions with law enforcement. Mark also represents clients in regulatory and state attorney general investigations, and data breach class actions.



Mark is an IAPP CIPP/US, CIPT and Fellow of Information Privacy (FIP). He is also a Certified Information Systems Security Professional (CISSP) and Certified Ethical Hacker (CEH).
