Hubert counsels businesses of all sizes in complying with data privacy laws and regulations, including the California Consumer Privacy Act, the California Privacy Rights Act, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Biometric Information Privacy Act, the Children’s Online Privacy Protection Act, the Gramm-Leach-Bliley Act, and the EU General Data Protection Regulation. Hubert has experience drafting and reviewing privacy policies, terms and conditions, information security policies, and data processing agreements, as well as working with companies in conducing data mapping analysis, standing up data privacy compliance frameworks, and building global privacy compliance solutions.

Product development and data privacy risks are also matters that Hubert regularly provides counsel to clients on as well as compliance solutions for new products from consumer goods to mobile applications.

In the past he has advised companies on their use of biometric data, negotiated data sharing agreements, and advised companies on data incident response. He also advises start-ups on cryptocurrency, blockchain, and smart contracts, including counseling NFT platforms and crypto wallets on international data privacy risks.

Hubert is a Certified Information Privacy Professional – United States by the International Association of Privacy Professionals.

Throughout his career, Hubert has also represented clients in matters involving claims of copyright infringement, Computer Fraud and Abuse Act and Digital Millennium Copyright Act violations, as well as other federal and state law claims related to unauthorized use of intellectual property.

He graduated magna cum laude, Order of the Coif, from Chicago-Kent College of Law where he served as an Executive Articles Editor for the Chicago-Kent Law Review. He was also a member of the Moot Court Honor Society, Treasurer of the Data Privacy and Cyber Security Society and Treasurer of the American Constitution Society.

During law school, Hubert externed for Chief Judge Rebecca R. Pallmeyer of the U.S. District Court for the Northern District of Illinois and the Federal Public Defender’s Office in the Northern District of Illinois. After graduation, Hubert served as a Public Interest Law Initiative Graduate Fellow at the Federal Public Defender’s Office.

At Reed Smith, Hubert continues to serve pro bono clients. He has represented prisoners in Section 1983 claims, assisted in independent post-conviction review of a capital punishment case, and worked on a team challenging state congressional district maps. He is currently working on a team representing journalists suing a police department over their use of less-than-lethal force on journalists reporting from protests in the summer of 2020 and spring of 2021.
