Parallel Privacy: The Overlooked Frameworks Shaping Data Use in ANZ (and Beyond)

The ACCC and ACMA are increasingly enforcing alternative frameworks, such as the Australian Consumer Law and Telecommunications Act, to regulate personal data-related conduct in the communications sector and beyond. This panel will consider how these mechanisms have become an additional or alternative tool for privacy enforcement and why recent penalties for consent failures and data breaches, and proposed amendments to the law, signal a shift toward a more active, cross-regulatory enforcement environment. The panel will also consider how laws like the Spam Act and Do Not Call Register Act operate and are enforced as communications to individuals using data in novel and targeted ways.

• How to craft a unified compliance view for overlapping mandates such as the Privacy Act, Spam Act, Do Not Call Register and Telecommunications Act.
• Auditing of user journeys and interactions to move beyond clickwrap consent to genuine choice, especially in highly regulated areas.
