U.S. District Judge Thomas Thrash approved a $380.5 million settlement tied to the incident. The court's decision in the Tsao v. Captiva MVP could play a role in whether an appeal of the settlement succeeds, as the court found data breach victims must show more than an enhanced risk of identity theft to establish their constitutional right to sue. Oral arguments for the appeal begin April 20.
