Privacy and Data Policy Fellow at Stanford Institute for Human-Centered Artificial Intelligence Jennifer King and independent researcher Adriana Stephan published a white paper for the Georgetown Law Technology Review on the regulation of dark patterns and inspiration that can be drawn from the California Privacy Rights Act. The paper looks at regulatory approaches to dark patterns, challenges in measuring and evaluating them and makes recommendations for policymakers. The CPRA, they argue, “offers the opportunity for the state to take a leadership role in regulating dark patterns” and “presents a potential model for others to follow.” Editor’s note: IAPP Editorial Director Jedidiah Bracy, CIPP, chatted with King about notice and consent on The Privacy Advisor Podcast.
