Privacy and AI Product Counseling: Navigating the New Era
Friday, 9 Oct.
15:45 - 16:45 EDT
Intermediate level
Emerging technologies are reshaping how companies design and deliver products and services as artificial intelligence capabilities become embedded as core offerings or consumer-facing features. This session examines how in-house and outside counsel can provide integrated privacy and AI product counseling in a rapidly evolving legal landscape shaped by U.S. state privacy laws, AI regulations, FTC enforcement trends, pre-litigation risk, and the expanding international framework led by the EU AI Act.
Drawing on experience across financial services, retail and technology, the panel highlights practical approaches to advising on privacy issues and AI-enabled products, with particular focus on data governance, automated decision making, transparency, risk assessments, user rights and oversight.
Panelists will connect privacy by design and AI governance requirements to day-to-day product decisions, including how to engage early with cross-functional teams, evaluate data inputs and outputs, assess individual impact and translate regulatory expectations into workable guardrails that support innovation across the product lifecycle.
What you will learn:
- How to identify key privacy and AI risks in product development under evolving U.S. state privacy laws, AI regulation, FTC trends, pre-litigation risk and the EU AI Act.
- How to structure practical product counseling by engaging early with teams, evaluating data inputs and outputs, assessing individual impact and translating requirements into workable guardrails.
- How in-house and outside counsel can implement privacy by design, AI governance and oversight across the product lifecycle.
