In 2025, led by the states, U.S. privacy regulators levied more fines than in the prior five years combined. At the state and federal level, as well as in private class actions, multiple cases have settled in the range of USD 1 billion. With a new wave of privacy laws coming online across the country, enforcement and litigation activity is certain to rise, as state regulators deepen their benches and plaintiffs' counsel continue to advance creative theories. New enforcement priorities and styles are poised to emerge, with some states using audits and sweeps while others seek pre-suit settlements against a diverse range of businesses and still others pursue high-profile litigation against Big Tech targets.
