As generative AI systems become rapidly integrated into daily life, more and more users are inputting sensitive information into prompts and chats. But how will discussions with AI systems be treated when law enforcement demands companies hand them over? This session will examine how key laws — such Stored Communications Act, Electronic Communications Privacy Act, and the Fourth Amendment — are likely to apply user AI prompts, and how we should expect companies to respond to police demands. The importance and novel legal questions that will have important ramifications for users as we incorporate AI more and more into our daily lives will be explored.

What you will learn: 

  • What the expected legal standards, requirements, and protections are that will govern how tech companies respond to law enforcement demands for user AI prompts and conversations.
  • What, if any, flexibility the law provides to companies have to voluntarily share user AI prompts and conversations, and how the law may need to respond. 
  • How the public can be aware of whether and to what extent companies that provide generative AI are receiving law enforcement demands for user data and content.
