Managing agents in the agentic AI era: The critical role of purpose and data minimization

Agentic artificial intelligence was arguably a top AI trend in 2025 and there is no letting up moving through 2026, as organizations race to embed intelligent agentic systems into their products, customer journeys and operations. It's important to recognize the privacy and legal challenges that accompany such rapid deployment. 

As such, a greater spotlight shines on the importance of establishing proper guardrails — particularly around purpose and data minimization — to reap the benefits of more autonomous systems while ensuring agents access only the minimum data they need to perform their tasks, preventing unnecessary exposure, scope creep and noncompliant cross-border transfers.

Why agentic systems demand stronger purpose limitation and data minimizations

Agentic AI is not just a smarter chatbot. Where a basic generative model responds to a single prompt, an agentic system pursues an objective: it breaks a goal into subtasks, preserves and reuses context across a session, invokes multiple internal systems and external application programming interfaces and can take actions that modify records, issue communications or trigger contractual steps. 

In practice, an agent routinely aggregates inputs from many places — customer relationship management records, transaction logs, session history, directory data, third‑party enrichment feeds and outputs from other tools — and then recombines and acts on them.

Because agents draw and recombine data in this way, purpose limitation and data minimization are of heightened importance under Article 5 of the EU General Data Protection Regulation. Without tight design and governance, an agent can easily process data for purposes beyond those originally communicated to data subjects or retain more information than necessary. 

That drift can change the lawful basis for processing, create extra transparency obligations under Articles 12-14, and where the processing is likely to result in high risk, require a data protection impact assessment under Article 35.
