Managing agents in the age of agentic AI: The critical role of purpose and data minimization

As agentic AI rapidly expands, proper guardrails — particularly around purpose and data minimization — are necessary to realize the benefits of autonomous systems while reducing legal, privacy and compliance risks.

Agentic artificial intelligence was arguably a top AI trend in 2025 and there is no letting up moving through 2026, as organizations race to embed intelligent agentic systems into their products, customer journeys and operations. It's important to recognize the privacy and legal challenges that accompany such rapid deployment.
As such, a greater spotlight shines on the importance of establishing proper guardrails — particularly around purpose and data minimization — to reap the benefits of more autonomous systems while ensuring agents access only the minimum data they need to perform their tasks, preventing unnecessary exposure, scope creep and noncompliant cross-border transfers.
Why agentic systems demand stronger purpose limitation and data minimizations
Agentic AI is not just a smarter chatbot. Where a basic generative model responds to a single prompt, an agentic system pursues an objective: it breaks a goal into subtasks, preserves and reuses context across a session, invokes multiple internal systems and external application programming interfaces and can take actions that modify records, issue communications or trigger contractual steps.
In practice, an agent routinely aggregates inputs from many places — customer relationship management records, transaction logs, session history, directory data, third‑party enrichment feeds and outputs from other tools — and then recombines and acts on them.
Because agents draw and recombine data in this way, purpose limitation and data minimization are of heightened importance under Article 5 of the EU General Data Protection Regulation. Without tight design and governance, an agent can easily process data for purposes beyond those originally communicated to data subjects or retain more information than necessary.
That drift can change the lawful basis for processing, create extra transparency obligations under Articles 12-14, and where the processing is likely to result in high risk, require a data protection impact assessment under Article 35.
Controllers must therefore bake in constraints and safeguards — technical and organizational measures under Article 32 — to keep agent behavior aligned with the documented, lawful purposes for which data was collected.
Assessing necessity: Which data should an agent access?
Given that agents routinely aggregate and recombine data from multiple systems, the practical question becomes: which specific data elements does the agent actually need to achieve its lawful purpose? Determining necessity is not straightforward — agents rely on prior interactions and multiple sources, so every field or feed the agent can access should be assessed before deployment.
For example, does a procurement agent truly need entire litigation files, or will a supplier risk score suffice? Would aggregated transaction metrics meet the business need without exposing identifiers?
Those proportionality judgments must be made, recorded and enforced up front so processing remains purpose‑limited and proportionate under Article 5 of the GDPR.
Having clear data use rules to support purpose limitation and GDPR compliance
To help ensure data processing remains within purpose boundaries and complies with the GDPR, it is important to establish clear, actionable rules for agentic AI systems.
This includes explicitly defining what data the systems can access — such as customer names or order IDs — and specifying which external services they are permitted to call.
It is also essential to specify when human oversight is required. For example, instructions might limit the agent to only accessing contact details and recent transaction history related to a support request. Incorporating these rules into deployment processes helps demonstrate that data is only processed for its intended purpose, aligning with GDPR requirements under Article 5(1)(b).
Managing access and retention in agentic AI
Controlling who can see data and how long it is kept is crucial to meeting the GDPR's purpose and minimization rules. Practical safeguards include restricting access by role, so only specific accounts can read certain fields, using limited service accounts for agents, and blocking calls to unauthorized APIs.
Provide data to agents only for the short period needed and delete or revoke access as soon as the purpose is fulfilled. If data must be kept longer, document the legal justification and a clear retention period — often a short window such as 30 days — and require vendors to follow those limits in contracts.
Simple operational steps — automatically expiring session data, preventing agents from accessing nonapproved fields, and running regular checks to confirm deletion — make it much easier to show processing stayed within the stated purpose and avoided unnecessary exposure.
Managing cross border data flows
Another challenge is managing cross‑border transfers because agentic systems often call on external cloud services and third‑party APIs, creating chains of data movement that can cross jurisdictions and complicate GDPR obligations around purpose and minimization.
Organizations should map and monitor those flows and ensure any transfer outside the relevant jurisdiction only occurs when it directly supports the lawful purpose and is limited to the minimum data necessary.
In practice, this typically means separating identifying information from the signals an external service actually needs. Often, detailed personal records are kept within the same jurisdiction as the organization — for example, within the EU or European Economic Area if subject to GDPR — while only a confirmation, a nonidentifying token or aggregated summaries are shared externally.
Whether a simple "yes/no" identity check is sufficient, or only totals and averages are required for reporting, depends on the task. Contracts and straightforward technical checks should reflect those choices, and if a transfer isn't necessary for the agent's stated purpose, it should be avoided or redesigned so processing stays within the relevant jurisdiction.
