The RIALTO computerized database that has gathered information about taxpayers (individuals or companies and their executives) since 2006 in order to support the departments of Public Treasury during tax investigations will henceforth contain numerous and detailed data related to companies’ executives.
Indeed, an order (
arrêté
) of the Ministry of Budget of January 28, 2011, provides that the RIALTO database will contain specific personal data relating to the companies’ executives classified in five categories:
- identification data - name, surname, date and place of birth, personal and professional addresses, plus name, date of birth, professional activities and address of spouse or husband or PACS partner and dependents;
- family situation -married, PACS partner, cohabitant, single, divorced, separated or widowed;
- professional life - information related to the company (e.g. risks resulting from the economical context), role of the executive;
- economical and tax situation - tax situation (details of charges, analysis of income tax return for each type of income), assets declared (year and acquisition date of immovable and movable property, records of bank accounts open in the name of the members of the household tax), tax history, name, address quality of counselors, relationship between the executive and the activity of the company (current account, withdrawals, deduction limit, expenses of the executive, expenses reimbursement, benefits in kind, remuneration and income tax, income from movable capital and transfer of shares), and
- elements resulting from onsite tax investigations.
The Public Treasury is now able to conduct deep investigations on the tax situation of company executives, their relationship to their companies and probably their potential conflicts of interests with the companies.
