This session explores the critical intersection of data protection, cybersecurity, AI governance and digital resilience, drawing comparisons between the United Kingdom and key Asian economies. As both regions advocate for forward-looking, pro-innovation regulation, the discussion will examine what Asia can learn from the EU’s NIS2 Directive, Digital Operational Resilience Act (DORA), and the U.K.’s rapidly evolving frameworks for data protection and AI governance—especially in critical sectors. A spotlight will be placed on India’s Digital Personal Data Protection Act (DPDPA), which marks a significant shift in the country’s privacy landscape by introducing consent-based processing, cross-border data transfer provisions and obligations for data fiduciaries. The session will also address how companies and institutions across Asia are navigating a complex and fragmented regulatory environment, balancing national security concerns with innovation and interoperability. A key focus will be the challenges of cross-border data transfers between the U.K. and major Asian economies—India, Singapore and China—each with distinct regulatory frameworks. The discussion will reference international efforts such as the OECD guidelines and the Global CBPR Forum.
