Pushing For More Consent While Avoiding Users Fatigue: How to Square the Circle?

Consent is at a crossroad. On the one hand, the EU Commission is proposing in the digital Omnibus to include the cookie consent rule in the GDPR and to introduce an obligation to respect users consent signals from integrated consent management systems. By the same token, some regulatory initiatives propose to reduce user consent fatigue online by working on cross device consent or identifying low tracking activities exempted from consent, such as contextual ads. On the other hand, some DPAs rely on an extensive approach of consent requirements in their enforcement activities and develop, at a national level, guidance on ways and modalities for companies to evidence consent. So, what is the right balance? How can lawmakers and regulators meaningfully reduce user consent fatigue? Should they reduce the number of instances when users must consent or enable users to better manage their consent?
