This session examines three converging forces reshaping platform accountability for minors: DSA enforcement at the EU level, national age assurance requirements across member states and tort litigation in the United States. Earlier this year, U.S. juries held two major online platforms liable for negligent design causing harm to minors, signaling viable legal pathways for thousands of pending suits and over 40 state attorney general actions. Meanwhile, the EU has yet to establish a common standard for age assurance that reconciles privacy requirements with effective third-party verification. At the national level, member states are taking competing legislative approaches, creating fragmented and uncertain regulatory obligations for platforms operating across borders.
