In an opinion piece for The Media Institute, Kurt Wimmer of Covington & Burling discusses the need to update the Electronic Communications Privacy Act (ECPA) to reflect changes in technology, especially the cloud. Wimmer says the solution is the LEADS Act, which would update ECPA by requiring law enforcement to obtain a warrant under ECPA before accessing any customer communications stored in the cloud and would create a framework to address data stored outside of the U.S. “This issue and this act are bipartisan, common-sense and workable solutions that Congress should embrace and pass as soon as possible,” Wimmer writes.
