Despite U.S. District Court Judge James Donato granting Meta’s motion for summary judgment to dismiss a lawsuit brought on behalf of non-Facebook users in Illinois, Meta will face claims of a separate suit from those non-users, Courthouse News reports. In its argument for dismissal, Meta claimed it would have been unreasonable to notify and obtain consent from all non-users in Illinois, per the state’s Biometric Information Privacy Act. Now, Meta could be liable for violating another BIPA provision because it did not have a written policy explaining how biometric data would be used for non-users, dependent on if Illinois non-users can prove Meta took their biometric data.
