US Sens. open door to private right of action in federal privacy law

In a piece for The Brookings Institution, Tisch Distinguished Visiting Fellow Cameron Kerry dissected how a private right of action would boost the chances of U.S. Congress passing federal privacy legislation. Kerry's piece focuses on remarks from lawmakers at the Senate Committee on Commerce, Science, and Transportation's privacy hearing Sept. 29, which included an open stance on inclusion of a right of action. Kerry, who previously expanded on the right of action concept, said the dialogue at the hearing provides "objective basis" for a bipartisan agreement.
