In a news release, the European Commission announced it has published its second review of the EU-U.S. Privacy Shield. The annual review found that the U.S. “continues to ensure an adequate level of protection for personal data” under the framework and added that steps taken since last year’s report have served to improve the framework’s functioning. The commission noted it expects a permanent ombudsperson to be nominated by Feb. 28 and that failure to do so would result in the commission “taking appropriate measures, in accordance with the General Data Protection Regulation.” The report states, “The ombudsperson mechanism is an important element of the Privacy Shield framework and, while the acting ombudsperson continues to carry out the relevant functions, the absence of a permanent appointee is highly unsatisfactory and should be remedied as soon as possible.”
