Matheson Ormsby Prentice examines the Communications Act 2011, which came into effect late last month to implement "Directive 2006/24/EC on the retention of data generated or processed by or in connection with the provision of publicly available electronic communications services or of public communications networks" and repeals Ireland's prior data retention law. The new act requires service providers to retain data and make it available to Irish authorities in specific instances and includes provisions addressing those obligations as well as security measures for the data.
