The U.S. government and European Commission will have to find a solution for transborder data transfers following the invalidation of the EU-U.S. Privacy Shield agreement. Baker McKenzie Global Data Privacy and Security Business Unit Chair Brian Hengesbaugh, CIPP/US, explains that even though there are plenty of issues to consider when negotiating with the EU, the U.S. should not think small. "While no solution can offer perfect certainty on these complex issues in the digital age, the Biden administration should certainly 'go big' to seek to establish a long-term solution to global data transfers," he writes.
