A recent University of Oregon sexual assault case highlights a potential legal loophole for student medical privacy, iHealthBeat reports. During its preparation for the case, the university accessed the student’s health records and sent them to its attorney. The student had received mental health services at the university’s health clinic. In an open letter to university administrators, Jennifer Morlok, a senior staff therapist at the university’s counseling center, said university employees engaged in “potential illegal and unethical behavior” in accessing the records without consent. The university says it was within its rights under the Family Education Rights and Privacy Act.
