As the long-awaited proposed General Data Protection Regulation (GDPR) winds its way through the trilogue process, there have been some questions about the fate of Binding Corporate Rules for Processors (BCR-P). The Article 29 Working Party even expressed concerns “about the deletion of the possibility of BCR-P and considers it essential to re-insert them.” As Morrison & Foerster’s Lokke Moerel points out, “The companies that have already introduced BCR-P, or are in the authorization process, were alarmed.” In this post for Privacy Perspectives, Moerel analyzes the three iterations of the GDPR to assess whether the BCR-P function remains in this historic legislation.
