Earlier this month, the European Commission published a draft ePrivacy Regulation. Unlike its earlier iteration, a directive, the draft makes little effort to address the use of "cookies," abandoning completely the idea of getting user consent through banners on websites. In fact, writes Sachin Kothari, CIPP/US, "It is a big push for a structured framework on technology enablers for companies doing business within Europe." In this Privacy Tracker post, Kothari outlines the new regulation, including its increased scope of technology enablers, noting that it "looks comprehensive at face value." However, questions remain in terms of collecting data through third parties, interpreting do-not-track signals and how to create boundaries between marketing and analytical data.
