Recent cases have called into question the constitutionality of warrantless searches at home, prompting review by the Supreme Court of Canada, National Magazine reports. In one case, an Oakville, Ontario, man was arrested and charged with drug possession for the purpose of trafficking, though police initially responded to his home for the report of a possible domestic violence incident. Narwal Litigation’s Joven Narwal said the “apex privacy interests” in one’s own home are competing against “the desire of the state to secure evidence.”
