In the aftermath of the Supreme Court’s May 16 ruling in favor of Spokeo, Reuters reports that the decision “is already an issue” in three separate, pending privacy breach cases. Class actions involving the Children’s National Health System, Paytime and Conde Nast, have all used insight from the Spokeo ruling — some, in Conde Nast’s case, incorrectly, the report states. “It will be a long while until the lower courts decide who won Spokeo — but it is already clear that defendants in privacy class actions are going to wield the Supreme Court ruling like a weed wacker,” the report continues. Editor’s Note: The Privacy Tracker recently unpacked the Spoke decision here and The Privacy Advisor analyzed its likely impact here.
