The Wall Street Journal reports on last Friday’s release by the Article 29 Working Party (WP29) of its highly anticipated guidance on the recent European Court of Justice decision that invalidated Safe Harbor. “In theory, any legal mechanism is vulnerable to indiscriminate access to data—that is a level of uncertainty we have to live with,” said Hogan Lovells Partner Eduardo Ustaran, CIPP/E. Covington & Burling’s Monika Kuschewsky, CIPP/E, said, “The good news is that the European data protection authorities have agreed on a kind of grace period until the end of January.” Meanwhile, Facebook has applied to join Ireland’s High Court proceedings on the Schrems case against the Office of the Data Protection Commissioner.
