Pending federal legislation in the U.S. Senate may not pass due to privacy concerns, FedScoop reports. The Kelsey Smith Act would require cellphone companies to share location data with law enforcement in emergency cases. The tragic inspiration for the bill stems from the kidnapping and murder of the daughter of the bill's sponsor, Sen. Greg Smith, R-Kan. Privacy advocates, however, such as the American Civil Liberties Union and the Electronic Frontier Foundation, fear federal legislation would give law enforcement too much surveillance power. Lawmakers said they realize getting such legislation passed is a marathon and not a sprint. “We had all hoped this important measure would be ready for consideration today,” said Sen. John Thune, R-S.D., “however, the sponsors are still working to strike the right balance between public safety and privacy.”
