Gowling WLG's Brent Arnold and Alexandra Psellas examined whether Canadian courts are taking a firmer stance on what constitutes a privacy violation in class-action suits. Arnold and Psellas used privacy case studies, specifically a recent reconsideration of a $20.3 million settlement with Yahoo by the Ontario Superior Court of Justice, to outline the high standards to successfully plead a case. They wrote it is "increasingly apparent" courts will not bite on big settlements "without proof of real losses, or evidence linking losses to data breaches."
