Three Facebook users are asking a federal appellate court to revive a lawsuit alleging Facebook violated their privacy by tracking their activity on health sites, MediaPost reports. The three argue that Facebook tracked their “likes” on health websites and then implemented a targeted ad campaign based on them. In May, U.S. District Court Judge Edward Davila dismissed all claims against Facebook and the health sites, highlighting that users consented to Facebook’s data-gathering efforts since its use is included in the online disclosure. The plaintiffs have also sued the health sites for violating their own privacy policies, which were said to refrain from sharing personally identifiable information.
