MediaPost reports plaintiffs in a class-action suit against T-Mobile are asking a U.S. District Court judge in Maryland to keep their case regarding location data disclosures in the court rather than sending it to arbitration. The plaintiffs filed papers on Monday to counter T-Mobile's prior motion for arbitration based on terms in its user contracts. “This case must remain in a public forum,” the plaintiffs wrote. “If proven true, the allegations of the complaint would uncover an industry-wide wholesale disregard toward subscriber privacy rights in exchange for additional quarterly profit.”
