Reuters reports a legal recommendation that could influence the fate of the EU-U.S. Safe Harbor agreement is expected this week. European Court of Justice (ECJ) Advocate General Yves Bot will issue his opinion this Wednesday in a case originally filed by Austrian law student Max Schrems that alleges Facebook helped the U.S. National Security Agency collect Europeans’ data in violation of EU law. The relevant authority in the case, Ireland’s Office of the Data Protection Commissioner, originally rejected the complaint, arguing it was bound by the Safe Harbor agreement. Though not binding, Bot’s opinion could influence the ECJ’s final ruling in the case as well as Safe Harbor negotiations between the European Commission and the U.S., the report states.
