The U.S. Department of Health and Human Services Office for Civil Rights has proposed sharing a percentage of settlements with HIPAA data breach victims, HealthITSecurity reports. The agency will ask for the public’s opinion in order to find the best way to offer financial compensation to victims, as required by the Health Information Technology for Economic and Clinical Health Act. Mayer Brown Partner Marcus Christian said the proposal will be difficult for the OCR to implement, citing the challenges in determining who is harmed and questioning whether the OCR has the capacity to make those decisions.
