The Office of the Australian Information Commissioner issued guidance reiterating retailers collecting biometric information must comply with the Privacy Act. Under the regulation, retailers can "only collect sensitive biometric information if it’s reasonably necessary for their functions or activities, and where they have clear consent." Australian Information Commissioner and Privacy Commissioner Angelene Falk said “using high privacy impact technologies in stores carries significant privacy risks,” adding retailers need to demonstrate “a proportionate response to collect the facial templates of all of their customers.”
