The "potentially explosive" coupling of the results of the U.S. presidential election with the D.C. Circuit's ruling in PHH Corporation v. the Consumer Financial Protection Bureau leaves a host of questions regarding the CFPB "under the leadership of CFPB Director Richard Cordray," Morrison Foerster reports. "After providing some background, this alert will discuss some of the most pressing of those questions," the report states. The report specifically tackles 10 questions surrounding the situation, such as "When will the court decide whether to grant rehearing en banc?" and "When might the U.S. Supreme Court have an opportunity to weigh in?" Ultimately, however, the only question without a potentially clear cut answer is how everything will play out. "There are simply too many contingencies flowing from the possible interaction among multiple players ... to make any prediction with confidence," the report adds.
