In a blog post for Fieldfisher, Phil Lee, CIPM, CIPP/E, explains the differences between “unambiguous” and “explicit” user consent under the General Data Protection Regulation. “The two different models of consent translate into very different engineered solutions within products and services,” Lee writes. “In one, the ‘explicit’ consent model, nothing short of an opt-in tick box or declaratory consent statement will do.” With the “unambiguous” consent model, a notice with affirmative action is sufficient enough consent. “Their differences are subtle, but their similarities are great,” he adds.
