U.S. District Judge Loretta A. Preska ruled Thursday that U.S. law enforcement can force Microsoft to turn over emails it stores in Ireland, the Associated Press reports. Preska agreed with the findings of a magistrate judge who approved a sealed search warrant in December as part of a narcotics investigation. It came down to the question of who controlled the data rather than where it was stored. The judge did, however, stay the effect of her ruling to allow for an appeal from Microsoft, the report states. Microsoft General Counsel Brad Smith said the company will “appeal promptly and continue to advocate that people’s email deserves strong privacy protection in the U.S. and around the world.”
