Covington & Burling Partner Andrew Smith is expected to be appointed to lead the Federal Trade Commission’s Bureau of Consumer Protection, The New York Times reports. FTC Chairman Joseph Simons has put Smith’s nomination up for a vote and, if approved, would require Smith to recuse himself from investigating Facebook, Equifax and Uber because Smith has represented the companies previous to his nomination. Sens. Richard Blumenthal, D-Conn., and Elizabeth Warren, D-Mass., criticized Smith’s nomination, particularly due to his testimony for the trade group representing credit reporting agencies following the Equifax data breach last year. (Registration may be required to access this story.)
